GANFER SHORE LEEDS & ZAUDERER IS SUCCESSFUL IN TWO MAJOR ARBITRATIONS

      Ganfer Shore Leeds & Zauderer LLP, a New York litigation and real estate boutique, recently obtained two substantial victories for the firm’s clients in a construction arbitration and an employment arbitration.  The litigation team in both matters was led by the firm’s managing partner and head of litigation, Steven J. Shore. 


      In the first case, Ganfer Shore represented Paula Cooper, the pioneering owner of the internationally renowned Paula Cooper Gallery, which last year celebrated its fiftieth year of operation.  Ms. Cooper and her husband were the claimants in a construction arbitration against a contractor that badly mishandled the renovation of their penthouse cooperative apartments.  After a 19-day hearing before a retired Appellate Division Justice serving as a JAMS arbitrator, the Arbitrator issued a 43-page decision finding that the contractor, Iain Campbell Design, Ltd., breached numerous provisions of the parties’ design services agreement and construction contract.  The Arbitrator awarded the claimants damages of more than $865,000, plus interest going forward, and also directed that the contractor must pay the claimants’ attorneys’ fees and the costs of arbitration.
 

      In the second case, Ganfer Shore represented Dr. Robert Goldberg, the former Dean of the Touro College of Osteopathic Medicine, in a claim for unpaid compensation under his employment agreement with Touro.  After extensive proceedings including 10 days of arbitration hearings before an American Arbitration Association arbitrator, the Arbitrator issued a 45-page decision that held in Dr. Goldberg’s favor and awarded him $644,000 – the full amount he had sought, plus interest – in damages for Touro’s breach of the agreement.  In addition, the Arbitrator granted Dr. Goldberg monetary sanctions, in an amount to be determined, as a remedy for misconduct by Touro during the document discovery process.  

      “We are pleased that in both of these significant matters, involving two very different types of disputes, we were able to persuade the independent arbitrators that our clients had the facts and the law on their side, and obtain the substantial arbitration awards to which they were entitled,” said Mr. Shore.  Ganfer Shore has filed petitions to confirm both arbitration awards and enter judgment on them, which are pending in the New York State Supreme Court.
